SECTION 1 - GENERAL CONDITIONS
Kaloya Skin Care Spa & Laser offers this website, including all information, products, and services available from this site or our retail. Your usage of our products and services implies your acceptance of all terms, conditions, policies, and notices stated here. These Terms & Conditions apply to all users of the site, including users who are browsers, vendors, customers, or merchants.
Please read these Terms & Conditions carefully before accessing or using our website or services. By accessing or using any part of the site or at retail, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

Any new/existing product or services offered by us, will be covered under this Terms & Conditions. We reserve the right to update, change or replace any part of these Terms of Service by posting updates or changes to our website. It is your responsibility to check this page periodically for changes.

SECTION 2 - REFUSAL
We reserve the right to deny rendering the service under the following conditions:
- If the customer is suffering from an unknown skin infection or disorder.
- If Doctor has strictly prohibited any skin treatment.
- If we have recommended our client to take Doctor’s advice before taking any skin treatment.
- In case of recent surgery.
- In case of pregnancy.
- Any major health issues.

If the customer insists on us doing the treatment, we won’t be responsible for any adverse outcome.

SECTION 3 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right to modify or discontinue the services without any notice.

SECTION 4 – PRODUCT
We offer products after determining your skin type. The product advised to you is based on our expert knowledge; In a rare situation, the product might now suit you because of your skin sensitivity. Please check our “Return Policy” for returning the products to our retail center.

SECTION 5 – TAXES
The amount paid for the purchase of products and services is taxable. Taxes is applicable on all mode of payments whether it is through cash, Debit Card, Credit Care, or E-Transfer.

The Tax percentage can change without any prior notice to the customer. You are requested to revisit the Terms & Conditions or ask our representative at the retail for more detail.

SECTION 6 – MODE OF PAYMENTS
We accept payment in the following forms:

1. • Cash
2. • Debit Card
3. • Credit Card
4. • E-Transfer

SECTION 7 – CANCELATION POLICY
As a customer, you have a right to ask about the Cancelation policy before opting for any service. Following are the practices implemented at our retail stores:
1. To avoid the cancelation charges, you should inform the Kaloya Team at least 24hrs before your appointment date. Cancelation charges are $ 25, irrespective of any service it is.
2. In case you have booked an appointment on the same day. Then you are requested to inform us 2 hours before, to avoid cancelation charges.
3. We do not offer any refund of your amount if you have purchased sessions in advance.
4. For upgrading your purchased session, you have to pay the remaining balance.

SECTION 8 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless our company: its Owners, Directors, Employees, Interns, Contractors, Agents, Licensors, and Suppliers from and against all losses, expenses, damages, and costs, including attorneys’ fees; Resulting from any violation of these Terms of Service or any activity (including negligent or wrongful conduct) related to your use of our website, or the content it incorporates by reference.

SECTION 9 - SEVERABILITY
You agree that if parts of these Terms of Service are found by law to be invalid, illegal, void, or unenforceable, the remaining parts will continue to be enforced and valid. The Laws are broken outside these Terms of Service or concerning third-party sites you’ve violated service terms for remain enforceable.

The failure or delay of any enforceable and valid provisions in these Terms of Service will not constitute a waiver of their enforceability or validity.  This agreement supersedes and overrides prior agreements: including but not limited to other versions of our Terms of Service and relating content published on this website.

SECTION 10 - GOVERNING LAW AND JURISDICTION
These Terms of Service and all agreements made between you and our company will be governed and enforced per the laws of British Columbia and Canada; without regard to the conflicts of laws in any other jurisdiction, including your own, that of our suppliers, or otherwise. Any filing of claims regarding these Terms of Service will be conducted at a courthouse or jurisdiction nearest our company. You will continue to abide by your local laws.
